General Terms and Conditions of Use

PICKME mainly operates a parcel collection and storage service (hereinafter the “Platform”) for its customers (the “Users”), outside the home for private individuals.
It operates through the website www.mypickme.com and the Pickme mobile application (the “Platform”).
The Website and the Application are open to all users of the Internet.

PART 1: TERMS OF USE OF THE PLATFORM

Article 1: Definition of the General Terms of Use (GTU)

The Pickme General Terms of Use (GTU) define the terms and conditions under which Pickme provides the parcel delivery service between neighbors. Any person consulting or using the Platform (even if they do not have an account and do not use the services), as well as any person using the services of the Platform (hereinafter together referred to as the “Users”), is invited to review the GTU.

From the moment they are accepted, these General Terms shall apply to Users for any use of the Platform and/or the services offered on the Platform.

These GTU apply to any new version or modified version of the Platform, regardless of the method of access and the platform used (including, in particular, any mobile website, mobile application, affiliated website, mirror site, or duplicate site that may be developed).

Article 2: Company details

The Website is published by PICKME, a simplified joint-stock company with share capital of €5,712, whose registered office is located at 5 Avenue du Général de Gaulle, 94160 Saint-Mandé, registered with the Créteil Trade and Companies Register under number 879 837 326.

Article 3: Access to the Platform

Access to the Platform is free of charge.

Subject to possible breakdowns, maintenance operations necessary for the proper functioning of the Platform, and events of force majeure, Pickme endeavors to provide access to the Platform 24 hours a day, 7 days a week.

However, Pickme cannot guarantee the availability of the Platform and the services and reserves the right to temporarily or permanently interrupt access to all or part of the Platform or all or part of the services at any time, without prior notice. Pickme shall not be held liable for such interruptions.

In the event of an interruption, the User acknowledges and agrees that Pickme shall not be responsible for any consequences arising therefrom for the User or any third party.

Article 4: Intellectual property

The content and structure of the Platform, including its graphic design and all texts, images, logos, sounds, videos, and databases composing it, are the exclusive property of Pickme or of third parties with whom Pickme has entered into agreements allowing their use.

The Pickme trademark is a registered trademark belonging to Pickme.

Any representation, reproduction, use, modification, translation, or distribution, whether in whole or in part, of these elements, by any process and on any medium whatsoever, without Pickme’s prior written authorization, is strictly prohibited and may constitute an infringement of intellectual property rights, in particular copyright and trademark rights, engaging the civil and criminal liability of its author, notably under Articles L 335-2 et seq. and L716-9 et seq. of the French Intellectual Property Code.

Reproduction of the website and its pages is prohibited, except with Pickme’s express authorization.

Article 5: Hyperlinks

The Platform may contain hyperlinks to other websites available on the Internet. By accessing these other websites, you leave the Platform. Accordingly, Pickme cannot under any circumstances be held liable for the content or operation of such third-party websites, for any direct or indirect damage caused by such websites, or for the User’s use of such third-party websites.

It is possible to create a link to this website’s presentation page without Pickme’s express authorization, provided that the site is displayed in a new browser window.

Pickme reserves the right to request the removal of any link it considers inconsistent with the purpose of the Platform.

Article 6: User commitments

The User agrees not to use the Platform for fraudulent, unlawful, or immoral purposes.

In particular, the User agrees not to:

  • hinder or disrupt the proper functioning of the Platform, the servers, or the networks used to access it;
  • modify, delete, or extract all or part of the Platform;
  • reproduce or copy the Platform;
  • publish unlawful, insulting, threatening, defamatory, racist, sexist, obscene, disrespectful, political, religious, etc. content;
  • publish defamatory or slanderous content that could harm the reputation of Pickme, its partners, or its service providers.

By using the Platform, the User agrees that communications may be exchanged electronically. Pickme may publish any general information on the Platform.

Article 7: Pickme’s liability

7.1 Regarding information and documents on the Platform

The information and documents on the Platform come from sources considered reliable and verified. Such information may nevertheless contain inaccuracies and typographical errors. Pickme reserves the right to correct them when such errors are brought to its attention.

Accordingly, Users are advised to verify the accuracy of the information and documents made available on the Platform.

The information and documents available on the Platform may be modified at any time and may be updated. In particular, they may have been updated between the time they were downloaded and the time they were used.

Use of the information and documents available on the Platform, and the consequences thereof, are the sole responsibility of the User, and Pickme shall not be held liable in this respect. Pickme shall under no circumstances be held liable for any damage of any kind resulting from the interpretation or use of the information and documents available on the Platform.

7.2 Miscellaneous

The User is solely responsible for any additional or incidental costs resulting from their use of the Platform, including in particular communication costs, software and/or equipment acquisition costs, repair or data storage costs, rental or licensing costs, etc. Under no circumstances may Pickme be required to bear such costs or compensate them as damages.

PART 2: TERMS OF USE OF THE SERVICES

The Platform offers the User a service that connects private individuals for the collection and pickup of parcels between neighbors (hereinafter the “Service(s)”).

The Service is based on a collaborative and community spirit of mutual aid, with social and ecological goals, and is in no way a commercial freight transport service.

The Service is intended only for adult natural persons acting in a non-professional capacity and residing in France.

Article 1: Creating a member account

To use the Services, the User must create an account on the Platform by entering their first name, last name, postal address, email address, mobile number, and password. By creating an account, the User becomes a member of the Pickme community (hereinafter a “Member”).

In addition, any Member wishing to use the Platform to offer to receive parcels at home must provide their bank account details. Other information may also be provided by the Member, such as a photo, proof of address, and identity document.

The Member must have personal liability insurance and be able to provide proof of such coverage. The Platform may include features enabling a link with a social media account for various purposes (for example, a Member may connect to their Facebook account to upload a photo).

The Member certifies that the information provided when creating their account is accurate and precise and agrees to update and keep such information as accurate as possible while using the Platform. Creating an account requires completing a data form, including personal data. The processing of such data is described in the Pickme Privacy Policy.

Members certify that the information provided to create their account is entirely accurate. It is prohibited to create an account under the identity of a third party or under a false identity. In addition, only one account per person is allowed. Any breach of this article may result in the immediate suspension or deletion of the relevant person’s account.

Validation of account creation is also subject to acceptance of these GTU.

Article 2: Operation of the Service

Each Member may offer to receive parcels for neighboring Members (becoming a “Relay Neighbor”) and/or have a parcel delivered to one of their neighboring Members (hereinafter the “Final Recipient”).

2.1 The Relay Neighbor

To become a Relay Neighbor, the Member must be the owner or tenant of their home, log in to their profile, and fill in their daily or weekly availability in order to appear among the available neighbors when a Final Recipient searches for a Relay Neighbor from partner e-commerce websites.

To become a Relay Neighbor, the Member must be able to provide valid proof of liability insurance, submit an identity document, and a proof of address in order to receive transfers of money earned through the Platform into their account.

These documents must be uploaded to the Platform in order to validate acquisition of Relay Neighbor status and obtain a positive rating. However, it is specified that the Member does not need to complete this verification process in order to begin providing services as a Relay Neighbor.

The Relay Neighbor agrees to communicate with the Final Recipient regarding the dispatch, delivery, and pickup of the parcel, and in the event that the parcel is lost, stolen, or damaged.

Delivery terms

The Relay Neighbor is informed when the carrier is out for delivery with the parcel for which a neighboring Member has designated that Relay Neighbor to receive it. It is then possible to track the progress of parcel delivery on the Platform, based on the information provided by the e-merchant and the carrier.

The Relay Neighbor must make themselves available to receive the parcel at the place and during the times indicated on the Platform. Upon receipt of the parcel, the Relay Neighbor must personally check its general condition. If the parcel shows visible signs of damage, the Relay Neighbor must refuse the parcel and send photos of these signs of damage as soon as possible.

If there is any issue with the parcel’s general condition, the Relay Neighbor must refuse delivery and contact Pickme immediately. If the parcel’s general condition is satisfactory, the Relay Neighbor must confirm receipt by scanning it via the application.

It is specified that the Relay Neighbor is in no way responsible for the internal condition of the parcel.

Once the parcel has been received, the Platform is updated automatically.

The Final Recipient is then notified by email that the parcel has been collected.

The Relay Neighbor must then contact the Final Recipient to arrange a handover slot on the same day or the next day.

Parcel storage terms

The Relay Neighbor agrees to:

  • have sufficient storage space to receive the parcel;
  • take the greatest care of the parcel during storage, in particular by storing it in a dry place protected from humidity;
  • comply with any specific storage requirements for certain parcels that may have been communicated in advance;
  • keep the parcel in a safe place and take all reasonable measures to prevent loss, damage, or theft of the parcel;
  • not open or tamper with the parcel, the shipping documents accompanying it, or the parcel’s external labeling.

Handover terms

The Relay Neighbor agrees to hand over the parcel to the Final Recipient as quickly as possible and to cooperate fully with the Final Recipient in order to hand over the parcel according to their respective availability. When the Relay Neighbor and the Final Recipient meet, a 4-digit pickup code is exchanged to identify the Final Recipient’s profile and ensure that the parcel is indeed theirs.

Alternatively, the Final Recipient may be identified by means of a valid identity document, which the Relay Neighbor must verify and photograph on the Platform. The Relay Neighbor must hand over the parcel only if the pickup code is validated or if the identity document has been verified and photographed via the Platform. Failing this, the Relay Neighbor incurs liability.

Once the code has been validated or the identity document verified by the Platform, the Relay Neighbor’s assignment is complete. The Relay Neighbor’s Pickme electronic wallet will then be credited.

If the Relay Neighbor fails to hand over the parcel to the Final Recipient within a reasonable period or after three (3) canceled meeting attempts due to the Relay Neighbor’s fault, the Relay Neighbor remains obliged to deliver the parcel to the Final Recipient, but Pickme will not credit their account after verification of the transaction. Conversely, if the impossibility of handing over the parcel after three (3) attempts is attributable to the Final Recipient, the Relay Neighbor must inform Pickme without delay so that the issue can be resolved.

The collaborative spirit of the Site is expressly recalled. Under no circumstances is the Service intended for commercial gain or profit-making activities. As such, the activity of Relay Neighbors must remain incidental and marginal. In this regard, Relay Neighbors expressly acknowledge that over one calendar year they may not receive more than €3,000 in tips.

After the parcel has been handed over, the Final Recipient may rate the Relay Neighbor on the Platform. The Platform sends a warning to the Relay Neighbor if their average rating falls below the average of the whole community. Pickme reserves the right to suspend or delete the account, access, and use of any Relay Neighbor whose ratings or comments are more than 30% negative.

2.2 The Final Recipient

The Final Recipient searches for and selects a Relay Neighbor based on the latter’s rating, availability, and proximity. The Platform allows the Final Recipient to locate Relay Neighbors near their home on a map, directly from partner e-commerce websites or carrier websites. Once the Final Recipient enters the date or date range for the expected delivery of their parcel, the map displays only the Relay Neighbors who have indicated that they are available on that date or dates.

In some situations, Pickme or the carrier will redirect the parcel to a Relay Neighbor on the platform, according to the conditions displayed on the e-commerce or carrier website at the time of the Final Recipient’s choice.

The Final Recipient can view the public profile of each Relay Neighbor, including their name, location, and in some cases phone number, as well as the ratings they have received. When the Final Recipient selects the Relay Neighbor, the Platform provides the exact postal address of that Relay Neighbor. The Final Recipient can then collect their parcel at that address as soon as it has been delivered by Pickme. The Final Recipient must then validate the transaction using the verification code sent to them.

The Platform sends a notification by email and via the mobile application to the Relay Neighbor to inform them that they have been selected by a Final Recipient and to indicate the delivery date(s) and possibly time slot provided by the Final Recipient.

By using the Platform, the Final Recipient agrees, represents, and warrants that they will:

  • not have any dangerous items (including biohazardous items) or illegal items (including illegal drugs or medicines) delivered to the Relay Neighbor, and release the Relay Neighbor and Pickme from all liability in the event that the Final Recipient’s parcel contains a dangerous or illegal item;
  • not knowingly or willingly create or contribute to dangerous situations or situations that increase the risk of physical injury or damage to any movable or immovable property belonging to the Relay Neighbor;
  • communicate and cooperate, as far as possible, with the Relay Neighbor regarding shipment, delivery, and collection of the parcel, particularly in order to collect the parcel according to their respective availability;
  • collect their parcel as soon as possible after receiving confirmation of receipt by the Relay Neighbor, while respecting the Relay Neighbor’s availability, within a period ranging from 7 to 15 days.

If the Final Recipient fails to collect the parcel from the Relay Neighbor due to the Final Recipient’s fault after three (3) unsuccessful handover attempts under circumstances chosen by each party, the Relay Neighbor may inform Pickme and may potentially be released from all responsibility regarding the parcel.

Conversely, if the Final Recipient is unable to collect their parcel after three (3) attempts due to the Relay Neighbor’s fault, the Final Recipient must immediately inform Pickme so that the issue can be resolved.

The Final Recipient must be aware that parcel pickup may be subject to force majeure events or events beyond the control of the Relay Neighbor or Pickme (bad weather, road accidents, scheduling issues). Neither the Relay Neighbor nor Pickme may be held liable for such events.

The Final Recipient may leave a review regarding the Relay Neighbor and the receipt of the parcel and assign a rating to the Relay Neighbor. They agree to provide honest reviews and ratings.

Article 3: Liability relating to parcels

The User declares that they have been informed and accept that Pickme states that it has entrusted parcel transport to a transport company.

Pickme shall ensure, either directly or through its carrier, the condition of the parcel at the time it is taken in charge, and shall inform the Final Recipient without delay if it identifies any issue with the condition of the parcel or its packaging.

The carrier is responsible for the parcel until it is physically handed over to the Relay Neighbor.

Following proper delivery and validation by the Relay Neighbor through scanning the parcel, the Relay Neighbor becomes the custodian of the parcel and is responsible for it until it is physically handed over to the Final Recipient.

If the parcel is stolen, damaged, or lost while under the responsibility of the Relay Neighbor, the Relay Neighbor agrees to inform the Final Recipient and Pickme immediately and may be required to replace the parcel with an identical item or reimburse the Final Recipient for the value of the parcel.

Once the parcel has been handed over by the Relay Neighbor to the Final Recipient, the Final Recipient assumes all risks and responsibilities.

Article 4: Pickme’s liability

The Platform is an intermediary platform. Pickme is therefore a third party to the communication between the Relay Neighbor and the Final Recipient.

No obligation or liability may be imposed on Pickme regarding exchanges between the Relay Neighbor and the Final Recipient.

Pickme does not control the information exchanged between Members, particularly regarding the nature and contents of parcels.

Article 5: Members’ commitments

Members undertake to comply with these GTU, in particular the rules relating to use of the Service. In the event of non-compliance, Pickme may restrict or remove the Member’s access to the Service or may refuse to credit a Relay Neighbor’s account.

Members also agree to comply with all applicable laws and regulations relating to the shipment, delivery, and receipt of parcels, including all rules and policies of the delivery company handling the parcel.

In addition to all other commitments mentioned herein, Members agree to:

  • not use the Platform for professional or commercial purposes;
  • not request any additional payment when handing over a parcel;
  • not provide Pickme or other Members with any false, misleading, deceptive, or fraudulent information;
  • not engage in any behavior or make any statement (including in comments and reviews relating to the use of the Service left on the Platform) that is unlawful, contrary to public decency, defamatory, racist, violent, offensive, insulting, discriminatory, misogynistic, obscene, or incites hatred, etc.;
  • not infringe Pickme’s rights or image, in particular its intellectual property rights;
  • not contact another Member through the Platform for any purpose other than defining the delivery, collection, or handover arrangements for parcels;
  • not transfer, assign, or pass on to any third party any right or obligation arising from these GTU or the use of the Service without Pickme’s prior express consent.

Finally, Members agree that the contractual information relating to each parcel pickup may be communicated to them by confirmation email.

Article 6: Payment

Pickme will charge the e-commerce website or the carrier a commission on the total amount of the parcel pickup service performed by the Relay Neighbor. This amount corresponds to the fee for the service of connecting the Relay Neighbor and the Final Recipient.

The remainder of the amount will be paid by Pickme into the Relay Neighbor’s electronic wallet for the service rendered once receipt and delivery of the parcel to the Final Recipient have been validated on the Platform.

The Relay Neighbor will be rewarded for being available to collect parcels for their neighborhood, at a rate of €0.20 per parcel received and delivered. Additional bonus rewards may also be granted according to monthly parcel reception and delivery thresholds. On average, the total compensation per parcel (fixed amount + bonus) is approximately €0.40.

Annual earnings are capped at a maximum of €3,000.

The Relay Neighbor may choose to transfer the amount accumulated in their Pickme electronic wallet to their bank account once at least €15 has accumulated in the wallet.

PART 3: MISCELLANEOUS

Article 1: Modification of the terms of use

For the purpose of adapting to changes in the Platform and the Services, Pickme reserves the right to modify these GTU at any time and without prior notice.

The GTU applicable to the User (including Members) are those in force on the date of use of the Platform or the Service.

Article 2: Governing law

These GTU, and more generally any dispute relating to the use of the Platform or the Services, are governed by French law and subject to the exclusive jurisdiction of the competent courts of Créteil.

In the event of a dispute, and after any attempt to reach an amicable solution with the other party has failed, the User may, in accordance with Articles L. 612-1 et seq. of the French Consumer Code, refer the matter to a consumer mediator.

Article 3: Miscellaneous provisions

For any questions relating to the GTU, the use of the Platform, or the Services, the User may write to us via the contact form on the website www.mypickme.com or by clicking here.

If any article herein is held invalid or unenforceable by a competent court or by a legislative or regulatory text, it shall be removed without affecting the validity or enforceability of the remaining provisions.

The Relay Neighbor shall remain personally and definitively responsible for any declarations and any payment of taxes, duties, or contributions linked to tax or social obligations that may result from parcel receptions.

These GTU, together with any documents they refer to, constitute the entire set of terms governing the relationship with any User (including any Member) and replace any prior provision, discussion, negotiation, or agreement.

Pickme’s failure to invoke any of the rights granted to it under these terms shall not be considered a waiver of such right and shall not prevent Pickme from invoking it later at any time.
